Agreement on the payment of alimony for a child
According to Article 189 of the Family Code of Ukraine, parents have the right to conclude an agreement on the payment of alimony for a child, in which to determine the amount and terms of payment of alimony.
The agreement on the payment of alimony for the child is concluded in writing and notarized.
Agreement on the payment of alimony (sample) can impose on the child:
- alimony payments as a share of the payer's earnings (income);
- payment of alimony in a fixed monetary amount;
- debt repayment for a certain time, etc.
In addition, the contract may provide for means of ensuring the fulfillment of obligations, for example, the payment of a penalty in the event of a delay in the payment of alimony, etc.

According to Art. 196 of the Family Code of Ukraine it is determined that the recipient of alimony has the right to collect a penalty (penalty) in the amount of 1% from the amount of unpaid alimony for each day of delay. That is, even in the absence of this condition in the contracts, the penalty may be calculated in accordance with the requirements of the law.
The size and term of alimony payments are essential terms of the contract. The absence of one of the listed conditions is the basis for recognizing the contract as not concluded (Art. 638 of the Civil Code of Ukraine).
The amount of alimony is determined by agreement between the parents, at the same time, the norms should also be taken into account Part 2 of Art. 182 of the Family Code of Ukraine, which establishes that the minimum guaranteed amount of alimony per child cannot be less than 50 % of the subsistence minimum for a child of the appropriate age.
It should be noted that the minimum recommended amount of alimony per child is the subsistence minimum for a child of the appropriate age and can be awarded by the court in case of sufficient earnings (income) of the alimony payer.
Termination of the contract is possible in connection with the conclusion by the parents of the contract on the termination of the right to alimony for the child, the transfer of ownership of real estate in accordance with the rules established Art. 190 of the Family Code of Ukraine, as well as in connection with the expiration of the contract or the child's coming of age.
Amendments to the agreement between the parents on the payment of child support can be made throughout its existence by concluding a corresponding agreement, which must be notarized.
